PUBLIC NOTICE: Public hearing on battery energy storage systems moratorium

The Henderson City-County Planning Commission will hold a Public Hearing on Tuesday, March 3, 2026, at 6:00 P.M. at the Henderson Municipal Center, 3rd Floor meeting room located at the Henderson Municipal Center, 222 First Street, Henderson, KY 42420. 

One or more members of the Planning Commission may participate via Zoom, and the meeting will be broadcast to the public live at the locations below.  This meeting will also be conducted as a video teleconference meeting as allowed under KRS61.826.  Any interruption in the video or audio broadcast at any location shall result in the suspension of the meeting until the broadcast is restored.

The following items will be heard:

  1. The Henderson Fiscal Court hereby proposes and originates the amendment of the Henderson County    Zoning Ordinance by amending the chapter Article XXXII – Battery Energy Storage Systems (BESS) as follows:  ADD §32.06 MORATORIUM: The remainder of this Zoning Ordinance and all other ordinances notwithstanding, there is hereby imposed a moratorium on the filing, processing, review, and acceptance by the Henderson Fiscal Court; the Henderson City-County Planning Commission (HCCPC); Henderson County Codes Administrator; the Henderson County Board of Zoning Adjustment (HCBOZA); or any other department, subdivision, agency, board, or commission of Henderson County government of any and all applications for rezoning, conditional use permits, or other types of applications for Tier 2 BESS, BESS projects, and BESS installations, moratorium shall remain in effect until December 31, 2026 or until such time as amendments to this Article, if any, are approved by the Henderson County Fiscal Court, whichever comes first, unless repealed or extended.
