The Henderson Fiscal Court heard a first reading and voted in favor of an ordinance that will create a two-year moratorium on battery energy storage systems.
The moratorium will start from the time of the final passage of the ordinance, which will most likely be at its next regularly scheduled meeting on May 12.
According to the language of the moratorium, it will last for two years unless a new ordinance regarding BESS is written and passed before then, at which time the moratorium will end.
The fiscal court in January passed a resolution for a one-year BESS moratorium, after it had voted to start the process for putting that in place at a December meeting.
As part of the process, the fiscal court then sent the issue to the Henderson City-County Planning Commission with the directive to hold a public hearing regarding the moratorium and make a recommendation about it. In March, the planning commission sent back its recommendation for a two-year moratorium.
