Terror on the Trail can again open after the Henderson County Board of Zoning Adjustments recently approved a conditional use permit containing numerous parameters it must meet.
Henderson County Codes Administrator Randy Tasa sent the Hendersonian the guidelines contained in the conditional use permit, which were approved at the county BOZA’s Feb. 9 meeting.
They are:
- The trail can operate only on two consecutive weekends maximum each year
- TOTT cannot begin to decorate the trail earlier than 60 days before its opening and must have the property cleaned up within 30 days after the end of the event
- TOTT must install a 670-foot privacy fence along the adjacent property at 1381 Ky. 416-East and it must be natural colors or have an evergreen privacy screening living fence approved by the codes administrator
- TOTT must obtain a special event permit annually
- TOTT must station a person to help direct traffic for parking and station a person to ensure the neighbor’s access to come and go from their property
- TOTT cannot erect permanent structures on the property to be used as sets, props, decorations or for the public to enter, but TOTT can place 10 facades to remain on the property
- TOTT must get an inspection from the county codes department 61 days prior to the first day of the event and an inspection at least 31 days after the final day of the event
- TOTT must use cones, signs, or a person at a neighbor’s property to make sure no one parks on her property
- TOTT must notify the neighbor of any event activities that would create loud noises or explosion that might be detrimental to her horses and people who may be riding them
The popular haunted trail, which is a nonprofit that raises money from its gate receipts that goes to local families caring for children with chronic illnesses needing special care, did not open last fall while it dealt with cited codes violations.
In 2024, TOTT raised $40,000 which was divided among four local families, according to founder and former director Matt Gibson.
