Sentencing for a Henderson man recently found guilty of sexual abuse of a child under 12 years old was pushed back to Nov. 30.
Barry Barnes, 57, was found guilty by a jury in September of two counts of first-degree sexual abuse of a child under 12 years old.
His sentencing was scheduled for Monday.
In court Monday, Barnes, however, told Circuit Court Judge Karen Wilson that he had a falling out with his attorney since the trial and asked for a public defender to represent him and for a delay in the sentencing, according to officials with the Henderson County Commonwealth’s Attorney’s office.
The sentencing will be pushed back to 11:30 a.m. Nov. 30, they said.
Commonwealth’s Attorney Herb McKee Jr., said he is seeking two five-year sentences—one for each count—to run consecutively for a total of 10 years.
